that nothing contained in this paragraph shall apply to
the election provided for in Section Nine of this Act
to elect the first Fruitland Commission.
(K) That bi-annually, commencing on the first Mon-
day of October, 1948, said Board of Election Supervisors
shall conduct an election by ballot for the election of the
Commissioners to constitute and be the Fruitland Com-
mission for the ensuing two years and until their succes-
sors have been duly elected and qualified. For such elec-
tions, there shall be one voting place in said Town, and
the polls shall be open and the ballots cast between the
hours of two o'clock P. M. and eight o'clock P. M. At such
election each registered voter shall be allowed to vote for
three candidates.
(L) That said Board shall prepare ballots contain-
ing the names of the candidates, who shall have complied
with the provisions of Paragraph N of this Section.
(M) That any person who shall be a registered voter
of the Town of Fruitland, who shall not have been con-
victed of a felony or a misdemeanor involving moral turpi-
tude, shall be eligible for the Office of Commissioner. Pro-
vided, however, the requirement of registration shall not
apply to the special election provided by Section Nine of
this Act.
(N) That a person shall be deemed a candidate for
the Office of Commissioner and his name, as such candidate
shall be placed on the ballot prepared by the Board of
Election Supervisors, provided such person shall, at least
ten days, including Sundays and Holidays, prior to the
date of such election, file with said Board a petition, signed
by at least five registered voters of the Town Fruitland,
which petition shall state: (a) The name and address of
the candidate; (b) the fact that such person is eligible
for the Office of Commissioner; (c) that such person
wishes his name placed on the ballot as candidate. Such
petition shall be sworn to by the person so filing the same,
before the Secretary Commissioner, or before another offi-
cer having authority to answer oaths in Wicomico County,
both as to the fact of his eligibility and as to the genuine-
ness of the signatures on such petition. No person shall
be deemed a candidate, nor shall his name be placed upon
the ballots unless the provisions of this paragraph shall
have been complied with. Provided, however, this para-
graph shall not apply to the special election provided by
Section Nine of this Act.
