CHAPTER 643.
(Senate Bill 340)
AN ACT to repeal and re-enact, with amendments, Sec-
tions 409 and 412 of Article 12 of the Code of Public
Local Laws of Maryland (1930 Edition), title "Gar-
rett County", sub-title "Oakland", as said Section 412
was amended by Chapter 601 of the Acts of 1939, relat-
ing to duties and remuneration of the Mayor and mem-
bers of the Town Council of Oakland, providing for in-
creases in the amounts to be paid for the services of
said Mayor and members of the Town Council of
Oakland.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Sections 409 and 412 of the Code of Public Local
Laws of Maryland (1930 Edition), title "Garrett County",
sub-title "Oakland", as said section 412 was amended by
Chapter 601 of the Acts of 1939, be and they are hereby
repealed and re-enacted, with amendments, to read as
follows:
409. No person shall be eligible to the office of Mayor
unless he shall have attained the age of thirty years, and
shall have resided two years next preceding his election
in said town and shall be a freeholder in said town of
Oakland. The Mayor elected at any regular election shall
hold office for two years from the first Monday in April
next after his election and until after his successor is
elected and qualified. Should a vacancy occur in the office
of Mayor by reason of removal from town, removal
from office, death, resignation or otherwise, the presi-
dent of the council shall perform all the duties of the
mayor and act as such until the next general election of
the Mayor and Council. Willful neglect of duty or mis-
behavior in office on the part of the Mayor is hereby
declared a misdemeanor, and on conviction before a trial
magistrate or in the Circuit Court for Garrett County he
shall be removed from office by the trial magistrate or Judge
who shall sit in the case, and any person who shall be con-
victed and removed from the office of Mayor as aforesaid,
shall be disqualified from holding any office in said cor-
poration. He shall have general supervision of the town,
see that the ordinances are enforced, and from time to
time report to the Town Council such matters as may in
his judgement require the attention of the Town Council.
He shall read and sign the minutes of the Town Council
