CHAPTER 640.

AN ACT to add a new sub-section to Section 11 of Article
72 of the Annotated Code of Maryland (1943 Supple-
ment), entitled "Oysters and Clams", sub-title "State
Oyster Culture," as said section was enacted by Chapter
929 of the Acts of 1945, said new sub-section to be
known as sub-section (i), and to follow immediately
after Sub-section (h) of said section, to require the
Department of Tidewater Fisheries or its successors
to expend all funds appropriated in the Budget for the
propagation of oysters and all monies required to be
credited by the Comptroller to the Oyster Fund to be
expended for the planting of shells and seed oysters and
for no other purpose and to provide for the appointment
of committees of practical oystermen to advise the
Department of Tidewater Fisheries or its successors in
the planting of shells and seed oysters.
SECTIONl. Be it enacted by the General Assembly of Maryland,
That a new sub-section be and the same is hereby added
to Section 11 of Article 72 of the Annotated Code of Mary-
land (1943 Supplement), entitled "Oysters and Clams,"
sub-title "State Oyster Culture," as said section was
enacted by Chapter 929 of the Acts of 1945, said new sub-
section to be known as Sub-section (i), to follow im-
mediately after Sub-section (h) of said section, and to
read as follows:
(i). The Department of Tidewater Fisheries or its suc-
cessors shall expend for the planting of oyster shells, other
cultch or seed oysters on the natural oyster bars or seed
areas or for the purchase of necessary equipment to plant
said materials and for no other purpose (1) all funds appro-
priated in the Budget for oyster propagation, and (2) all
monies required by Section 15 of this Article to be credited
by the Comptroller to the Oyster Fund. Any unexpended
balance in the Oyster Fund at the end of any fiscal year
shall remain in the Fund and be spent for the planting of
shells or seed oysters during subsequent years and shall not
be spent for any other purpose nor shall such moneys revert
to general funds. In order to assist it in the planting of
shells and seed oysters, the Department of Tidewater Fish-
eries or its successors shall have the licensed oystermen
select a committee for each Tidewater county of this State
of five representative licensed oystermen, who earn their
livelihood by catching oysters. In the planting of shells or
