to transport, or attempt to transport, outside of this State, for
any purpose whatsoever, unmerchantable oysters as declared
herein, whether the unmerchantable oysters be taken from or
caught on the natural beds or bars of this State, or from private
beds and lots in this State.
5. (a) Tonging License for Men. Any male person between
the age of fourteen and sixty-five who shall engage in the
taking or catching of oysters by tongs or patent tongs from any
natural oyster bar of this State, except in the waters of Wor-
cester County, or who shall be employed on any tong boat
shall first obtain a license as prescribed herein, provided, how-
ever, that no such person shall be deemed to be in default
under the provisions of this sub-section until the lapse of thirty
days from the beginning of the season where he shall take or
catch such oysters; and provided further, that no license
shall be; required for the taking or catching of oysters from
the waters of Worcester County.
(d) Issuance of License. Upon taking the oath described
in the preceding section and upon receipt of a license fee of
Three Dollars and Fifty Cents ($3.50) and twenty-five cents
as Clerk's fee, the Clerk of the Circuit Court of the County
wherein the applicant resides shall issue a tonging license au-
thorizing the person licensed to take or catch oysters with
tongs or patent tongs, subject to the further regulations or re-
strictions provided in this Article.
(i). Privileges of a Tonging License—Locations. Any per-
son granted a tonging license in the manner described in the
preceding sub-sections shall be entitled to take or catch oysters
with tongs and patent tongs during the season for taking
oysters as follows: In the waters of the county wherein such
license is granted; in the waters of the Potomac River; and in
the waters of the Chesapeake Bay, except that all waters
within one and one-half miles of Sandy Point, Hackett's Point,
Tolley's Point, Thomas' Point, Three Sisters Bar and Holland's
Point Bar shall be considered within the limits of Anne Arun-
del County; and the oyster bars of Entrance Lump, Hickory
Thicket, White Marsh, Gum Springs, Hunting Field, Wind-
mill Flats, Muddy Drain, Swan Point and Lighthouse Lump
shall be considered to lie within the limits of Kent County.
No licensed tonger shall take or catch oysters in the waters
of any county other than that in which the license was issued,
except, however, that duly licensed tongers of Queen Anne's
and Kent Counties may use the waters of the Chester River in
common; tongers of Dorchester and Wicomico Counties may
use the Nanticoke River in common; tongers of Calvert,
Charles and St. Mary's Counties may use the waters of the
