SEC. 25. And be it further enacted, That if any part of this
Act, or any section, sub-section, or a part of any section or
sub-section thereof, shall be held unconstitutional or invalid,
the same shall not affect the remaining part of this Act.

SEC. 26. And be it further enacted, That the officers of the
Town of College Park until the first biennial election under
the terms of this Act and until their successors are elected
and qualified, shall be and consist of: William A. Duvall,
Mayor; Stewart B. Shaw, Treasurer; Herbert W. Wells and
Emanel F. Zalesak, Councilmen at Large; Marion W. Parker,
Councilman for the First District; Charles R. Davis, Council-
man for the Second District; J. Chesley Mack, Councilman for
the Third District; John W. McKay, Councilman for the
Fourth District; and G. Stuart Parker, Councilman for the
Fifth District. The first biennial election under the provisions
of this Charter shall be held on the first Monday of May, 1947.
The Mayor and Common Council shall provide registration
books and places of registration, and, after due notice printed
in some county newspaper having general circulation in the
Town and by posters prominently displayed, shall conduct a
registration of the voters of the Town on one or more days
before said first biennial election and in conformity with the
provisions of Section 7 of this Act.

SEC. 27. And be it further enacted, That all of the official
acts of the Mayor and Common Council and Treasurer of the
Town of College Park, elected and acting under the provisions
of Chapter 1051 of the Acts of 1945, not inconsistent with the
order of the Circuit Court for Prince George's County dated
the 24th day of September, 1946, in the case of John R. Hess,
et al. vs. William A. Duvall, et al., Equity Number 14,668, are
hereby ratified and confirmed, and said Treasurer and other
officials elected and acting under the provisions of said Chapter
1051 are authorized and directed to pay any unexpended
balance of the funds which came into their hands by virtue of
their offices under said Chapter 1051 to the Mayor and Com-
mon Council and Treasurer created by this Act.

SEC. 28. And be it further enacted, That in the event the
Court of Appeals of Maryland in the case now pending before
it known as William A. Duvall, et al. vs. John R. Hess, et al.,
Number 86, October Term of 1946, shall hold Chapter 1051 of
the Acts of the General Assembly of 1945 purporting to incor-
porate the Town of College Park, to be a valid and constitu-
tional act and in full force and effect, then in that event this
Act of 1947 shall be wholly inoperative and void.

SEC. 29. And be it further enacted, That this Act is hereby
declared to be an emergency law and necessary for the imme-
