( 65 ) Snow hill Landing in the County aforesd at or upon the tenth day of October next ensueing the date of these prsents, to the true prformance whereof the Said Wm Round him Self firmly by his Said Bill that the Sum of fifteen hundred eighty three pound of tobacco he would well & truely Content & pay unto the Sd Henry. but the said William in his life time the Said Sum of tobacco hath not paid, nor Mary his wife in the time of her being sole Extrix nor the said John Since the intermarriage with the Said Mary the Said Sum of 1583 pounds of tobacco hath not paid And hatherto doth refuse to pay to ye great losse and damage of the sd Henry of 2000 lbs of tobacco and thereupon he brings this Sute &ca. Doe Rich: Roe } This Bill bindeth me William: Winslow, of Somerset County in the Province of Maryland Cordweiner my Heirs Extors Admrs or assigns to pay of Cause to be paid unto Henry Morgan of the aforesd County Planter his Heirs Extors, Admrs or Assigns, the full & just Sum of fifteen hundred eighty five pounds of good Sound Merchantable leaf tobacco and Caske Convenient at Snow hill Landing in the aforesd County at or upon the tenth day of October next ensueing the date hereof As Witness my hand & Seal this third day of March Anno. Plt Somerset Ss: John: Emett of this County Millwright was attached to Contra } answer unto Stephen: Costine of the County abovesd Planter in a plea of debt John: Emmett. Dft And whereupon ye abovesd Stephen by Sam:Worthington his Attorney Comes ~ ~ ~ ~ ~ ~ ~ and Sayes that the Said John is become & Stands justly indebted unto ye abovesd Stephen in ye just Sum of five thousand pounds of Merchantable leaf tobacco in Caske to be paid Convenient in Somerset County within ye Jurisdiction of this Court as doth & may appear by a Certain bond Obligatory under the hand & Seal of the Said John. April ye 25th 1689. And is here in Court produced, the Condition of which Obligation is Such that if the above bounden Jno: Emett his Heirs Extors & Admrs doe & Will at any time Convenient at ye reasonable request & demand of Stephen Costine his Heirs or Assigns Such a good Sufficient & indefeazable Estate of Inheritance in ye Law, make or Cause to be made to ye only use & behoof of the sd Stephen Costine his Heirs and Assigns for ever of & for one hundred & fifty Acres of Land being the Moiety or one half of three hundred Acres of Land taken up moitively betwixt Charles Racliffe & my Self & adjoyning upon a Tract of Land of three hundred Acres formerly taken up by me Called Dean Scituate by a pond being on ye Sea Side in the County of Somerset by Deeds and Evidences Sufficient in the Law or by any other Su - or lawfull means as by ye sd Stephen Costine his Heirs or Assigns of him or them or by their or any of their
