That whereas the Said Thomas ye 14th day of August in the year of our Lord 1690. at Pocomoke within the Jurisdication of

this Court by his Certain Writing Obligatory which the Said Henry with the Seal of the Said Thomas Signed bringeth

here into Court, the date whereof is the day & year aforesd acknowledged himSelf to be bound to the Said Sum of

3456 Pounds of tobacco, to be paid to the said Henry Convenient, to which payment the Said Thomas bound himself

firmly by the Said Writing Nevertheless the Said Thomas the Said Tobacco according to the tenour of the Said Bill or

Writing hath not paid but hath hitherto refused & doth Still refuse, to ye damage of the Said Henry of 5000 Pounds

of tobacco & thereof he brings his Sute &ca. Dent pr Quer. Plegs &ca. { Jno. Doe

Know all men by these Presents that wee Thomas Miller & Thomas Davis of the County aforesd in the Province of Maryland

Sawyers are holden & firmly bound into Henry Smith of the Same County, Mercht. in the full & just Sum of three thousand

four hundred fifty Six pounds of good Sound Merchantable leaf tobacco & Caske to be paid to the Said Henry Smith

his Certain Attorney. Extors Admr or assigns, to which paymt.well & truly to be made & done, we bind our Selves and

either of our heirs. Extors & Admrs Joyntly & Severally firmly by these presents Sealed with our Seals & dated this fourth

day of August 1690.

The Condicon of the above Obligation is Such that if the above bound Thomas Davis hs Heirs or assigns

Shall well & truly pay or Cause to be paid unto the aforesd Henry Smith his Heirs, Extors or Assigns the full & just

Two thousand One hundred & Sixty feet of good Sound Inch Cypress Planke:That is to Say One thousand & eighty

feet of Said Planke to be paid at or before the 10th. day of Janry Ensueing & one thousand & eighty feet of sd Plank

on or before the 10th. day of March ensueing the date of these presents, then this Obligation to be void & of none
