            And whereupon the plt by his Atto^rney James Sangster Comes & Sayes that the dft
is become & Stands indebted unto the plt in the full & just Sum of two hundred
pounds of good Sound Mertable tobacco Porke as doth & may appear by his Specialty under the
hand & Seal of the Said Dft bearing date the twenty Sixth day of April An^o. Domin 1689 where
in the Said deft did bind himSelf his Heirs Extors & Adm^rs to the Said Benjamine Keizer his
Assigns for the true paym^t. of the Same upon y^e 15^th. day of 10ber next Ensueing the Date of the
Said Specialty but the Said Deft fraudulently & Craftily intending to deceive the plt of the Said
Sum of 200lb of Porke hath hitherto denyed & yett doth deny to y^e plts great loss & damage
to the value of four hundred pounds of like Porke & thereupon brings this Sute &ca

Ordered that the Sheriff assign the Bail bond, which was this day produced in Court

And whereupon the Said Whittington in propria p^rsona Complaineth & Sayes, that he the
Said Vigerous deft is become & Stands indebted justly unto the plt in the full & just
Sum of two thousand pounds of good Sound Mertable leaf tobacco in Caske as by his bill
under his hand & Seal bearing date the 26^th day of June in the year of o^r Lord 1690
is now in Court ready to be produced, wherein the Defend^t. hath bound himself his Heirs
Executors Adm^rs or Assigns (notwithstanding all which) the defend^t fraudulently and
Craftily intending the plt to deceive of the aforesd Sum of 2000lbs of tobacco hath not
paid although often thereunto  required by the plt, yett the Same hath & Still doth deny
to pay to the plts great loss & damage to y^e value of 4000^lbs. of tobacco, & thereupon brings this
