( 185 ) March 15th 1692/3 And this day (viz) the fifteenth day of March anno.Domini 1692/3 / the Jurors (of) the aforesd Jury betwixt their Maties & Wm:Burch returns in Court being (all) unanimously agreed of their verdict. the plts l& Dft being likewise calld. the verdict is in (Th)ese express words read (viz) Wee of the Jury doe find him guilty of the Indictmt James. Curtiss foreman B Which verdict was pr Court Ordered to be entered ut Supra inserted // Courts judgmt thereon is that the Shoats might be in value 50 pound of Porke each Shote. the fourfold to be four hundred weight of Porke, which this Court Orders the Said Burch to pay to mr ffrancis Jenckins. Ordered pr Court that sd Burch give good Security for sd four fold & fees Ordered into Sheriffs Custody till the said Security be given. // Corporall punishmt. remitted Their Maties Somerset County Ss // Contra } The Grand Jury for the body of this County upon their Oaths Wm: Layton. doe prsent Wm: Layton of this County Labourer for that the ~ ~ ~ ~ ~ Said Wm: not having the fear of God before his eyes but moved by the instigation of the divell in or about the first day of ffebry in the year of our Lord 1691. at Wiccocomocoe, within the Jurisdiction of this Court two Shoats being the propper Shoats of mr ffrancis: Jenckins of this County of the value of two hundred pounds of Porke, being felloniously killed by one John:Cary of this County the Same did receive, carry away & conceal Contrary to the Peace, & against the forme of an act of Assembly in that Case made & provided. Dent Clk of prsentments _____________ The indictment being Read to which the Said Layton pleaded not guilty & for tryall put himself upon the Country. Whereupon Comand was given to the Sheriff to bring here twelve good & Lawfull men of his balywick that the matter in hand might be ye better understood . a List or pannel are returned as followeth (viz) James:Curtis Alexr Thomas Lawrence:Gary. James:Langreen. George. Goddard. Wm:Venables. Rich: Cary. Somerset Dickinson. Jno. Gray Roger Odowey. Rich. Tull Senr. Thomas:Smith 12. who being legally Sumoned & Sworn upon the holy Evangelists having heard the foresd Indictmt as also the Confession by the Said Layton are sent forth having recd their Charge. ____ And this day to witt the day aforesd the same Jury make their return in Court & being prticularly calld by their names are all unanimously agreed of their verdict The plts & Deft being likewise called the verdict is read as followeth Wee of the Jury find him guilty of the Indictment James: Curtiss foreman |
