Here in Court produced may appear, and the said Thomas to the said Henry in manner aforesd
being indebted did assume upon himself, and to the Said Henry faithfully promise that he y^e
Said Sum of 400 Pounds of Porke, when he should be thereunto requested, would well & truly
Content and pay Nevertheless the said Thomas his promise & assumption aforesd not regarding
but minding and fraudulently intending him the Said Henry in this behalfe to deceive & defraud
the said Sum of 400 Pounds of Porke to the said Henry hath not paid, but hath hitherto refused
and doth Still refuse to the damage of the said Henry of 800 Pounds of Porke & thereupon

did in Open Court Assume to pay to the plt both debt & Cost of Suit. whereupon the

And whereupon the plt by Edward. Jones his atto^rney Comes and Sayes that
the dft upon the Seaventh day of Jan^ry in the year of o^r Lord. 1690/1 then
became indebted unto the plt in the full & just Sum of twelve hundred pounds of good
Sound Mertable tobacco leaf tobacco in Caske, Convenient on Pocomoke River by the tenth
day of Novemb^r next ensueing the date of a Certaine writing under the hand and Seal of y^e
defend^t and here in Court produced, but the defend^t not minding his promise & assumption
but minding and fraudulently intending the plt to deceive in the Sum of 1200: Pounds
of tobacco, but hath denyed to pay, & still doth deny although often thereunto required ___
whereupon the plt Saith he is damnified & losse to the value of 2000 Pounds of tobacco and
