Joseph/ ( 133 ) 9ber 11th 1692 Wm Venables this day in Open Court assumed to remove the Banisters, &ca from Said Court house to another Court house if required, and to Sett them up in the New House & if not proportionable he will make them according to directions upon his own Cost & Charges as also doe Some other necessaries _______ - - - - -_________ Henry: Lynch Mercht.Plt. Somerset County Sc. Walter Lane Admr of all Contra }and Singular the goods Chattels & Creditts of Jos Walter:Lane Dft. Seward Late of this County decd was Sumoned ~ ~ ~ ~ ~ ~ ~ to answer, unto Henry Lynch of the aforesd County Merchant of a plea that he render unto him the just & full Sum of eight thousand nine hundred fourty two pounds of good Sound Mertable tobacco in Caske which from B him he deteineth &ca. C And whereupon the Said Henry by Peter Dent his Attorney Saith that ye Said Josias in his life time (viz) the 5th day of June in the year of or Lord 1680 at Pocomoke at Pocomoke within the Jurisdiction of this Court by his Certaine Bond or writing Obligatory which the Said Henry with the Seal of the said Josias in his life time Signed bringeth here into Court, the date whereof is the day & year aforesd acknowledged himself to be bound to the sd Henry in ye sd full & just Sum of 8942 Pounds of tobacco and Caske to be paid to the said Henry Convenient in Pocomoke River according to Act of Assembly, to the which payment well & truly to be made the Said Josias bound himself firmly by the said Writing. Nevertheless the said Josias in his life time, nor the Said Walter to whome Admrn of all & Singular the goods Chattels & Credits of ye Said Josias Since the death of the Said Josias, was Comitted nor either of them the Said Sum to the Said Henry hath not paid, although the sd Josias in his lifetime & ye Said Walter Since the death of the sd Josias have been thereunto requested to the damage of the Said Henry of 18000 pounds of tobacco & thereof he brings his Suite &ca Dent pr Quere. Plegs &ca Jno Doe Rich Roe And the Said Walter Admr aforesd, Comes & defends the force & injury wn &ca and prayes the hearing of the Said Bond or writing Obligatory he prayeth ye hearing the Condition of the Same, & it is read to him in these words _____________ |
