( 24 ) Seaward and Walter Lane administrators of all & Singular the goods Chattels and Creditts of the Said (decd) Signed by order of Cort this 11th day of June in the Second year of theire Royall Maties Reign and in the year of our Lord God one Thousand Six h undred and Ninety Edm: Beauchamap Cler Cur Maryland Somrset County Ss Wee doe hereby impower you mr Thomas Newbold & mr Edmund Howard apprayse the goods & Chattels of Josias Seaward deceased you having first Taken yor oaths before mr Georg Layfield ~ ~ one of their Maties Justices of the Peace for this County and you are to Certifie y true value Cort held y Second Tuesday in August next after the Date hereof . This Pr order of Cort Dated y 11th day of June in y Second year of their Maties Reign William & Mary over England &c. In the year of our Lord God one Thousand Six hundred and ninety Edm: Beauchamp Cler Cur. Memorandum: the 10th day of June 1691: Letters of Admrn was granted by the Court Soly to Walter Lane to Admr. all and Singular the goods &c. of Josias: Seaward deceased. as appears in Lib: AW f:101 which sd letters was drawn and directed to mr George: Layfield with Comission to appraisers as also ye bond (But) upon the 11th of August last past mr Walter Lane informed the Court that ye aforementioned Appraisers viz mr Thomas Newbold and mr Edmund Howard were both (sick) and humbly required other appraysers might ( ) which being considered this Court Orders that John: Emmett and Samuel: Collins appraise the Estate of Josias Seaward decd and therefore Comission was Sent to the sd appraisers viz Emmett & Collins from ye (said ) (George) Layfields with letters &ca. - - ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ Somerset County in Maryland. Know all men by these presents that we Walter: Lane. Donack: Dennis: John: Lane Gent. of the same County & Province aforesd, do acknowledge and confess our Selves to owe and are indebuted unto their Maties Wm & Mary by the grace of God of England &c in the behalf of the Orphants of Josias: Seaward late of this County deceased the just Sum of four hundred pounds Sterling money of England, which we promise to pay to their Maties for the uses of the Orphants aforesd, and for the true performance of the Same to be well and truly paid we bind us and each of us, our Heirs, Extrs & Admrs to their Maties or to their Successours for the uses aforesd. In testimony whereof we have here unto Sett our hands & Seals this 30 day of July in ye 3d year of their Maties Reign Anno. Domini 1691. - - - - - - - - - - - - - - - - - - The Condicon of this Obligation is Such that if the above bound Walter: Lane do well and truly Observe & Satisfie (the) last will and testament of Josias Seaward deceased bearing date the 27th day of September Ano: Dom 1689. as well as pay all and every the debts upon Order had and obtained from their Maties Justices of Peace in Court Sitting (so far forth) as the said Estate will extend or ye law require, and well and truly to observe the Severall Clauses mentioned - - letters of Admrn to you granted the 11th. day of July 1691 as also to make no wast Sale of destruction off in or upon the ( or) Estates of Orphants (viz) dwelling houses, out houses, lands woods orchards, ffences, Observing the law entitled Act for ye preservation of Orphants real Estates, as also to keep harmless the Justices of Peace of Somerset County for (proving) of Wills & granting Admrns and all other ye Officers, that then this Obligation to be void & of none effect otherways (to be) & remain in full power force & vertue Walter Lane Sealed Signed Sealed & delivered in the sight & prsence of. his Joseph Bowlle Richard ffarewell Donack X Dennis Sealed mark John: Lane Sealed |
