in the judgment of the court the public business and
convenience require it to do so.
     Court may
sit.
      SEC. 2.  And be it enacted, That the said court may
sit during the sessions of the Circuit court of Baltimore
county, as frequent and as long as it may deem proper
and necessary for the despatch of the business of the
said court.
Per diem.










Proviso.
     SEC. 3.  And be it enacted, That each of the judges
of the Orphans' court of Baltimore county shall be
paid by the commissioners of Baltimore county, upon
the certificate of the Register of Wills of said county,
the rate of three dollars per diem for the time they may
have been in session and five cents per mileage for
going to and returning from each session of the said
court, over and above ten miles of the distance from his
or their residence to the place of holding the said court;
Provided, however, that mileage shall not be allowed
more than once for a protracted session for two or more
consecutive days.
     Authority to
appoint bailiff.
     SEC. 4.  And be it enacted, That the judges of the
Orphans' court of Baltimore county, are hereby authorised
to appoint a bailiff, who shall attend each sitting
of the court, and perform such duties as the court and
Register of Wills of said county may direct, and shall
be paid quarterly upon the certificate of the Register of
Wills, by the said commissioners, two dollars per diem
for each day he may have been in attendance on said
court, and no mileage shall be allowed the said bailiff.
Repealed.
     SEC. 5.  And be it enacted, That the second section
of the act of January session eighteen hundred and
fifty-two, chapter one hundred and thirty-nine, which
proposed to provide for the pay of the judges of the
Orphans' court of Baltimore county, be and the same
is hereby repealed.
Repealed.
     SEC. 6.  And be it enacted, That the act of January
session eighteen hundred and fifty-two, chapter tow
hundred and forty-seven, entitled an act to regulate the
session of the Orphans' court of Baltimore county, and
the compensation of its bailiff, be and the same is hereby
repealed.
In force.
    SEC. 7.  And be it enacted, That this act shall go
into effect from the date of its passage.
