Authority to
pay debts.

SECTION 1. Be it enacted
by the General Assembly
of Maryland, That Dewit C. Handy, guardian of the
children of Smart B. Lecompte, late of Dorchester
county, be and he is hereby authorised to apply with
the approbation of the orphans' court of Dorchester
county, to the payment of the debts of Smart B. Lecompte
remaining unpaid, so much of the rents of said
real estate now in the hands of said guardian, or which
shall hereafter come to his hands as guardian as aforesaid,
as shall not be required for the maintenance and
support of the children aforesaid.

SEC. 2. And be it enacted,
That this act shall take
effect from its passage.

CHAPTER
80.
AN ACT to amend the act entitled, an act for clearing
out of Pocomoke River in Worcester County, by
means of a Lottery, passed at December session
eighteen hundred and forty, chapter two hundred and
fifteen.

Commissioners
appointed.
|
SECTION 1. Be it enacted
by the General Assembly
of Maryland, That Peter Whaley, Zadoc P. Henry,
Curtis W. Jacobs, Bailey Hickman and Littleton R.
Bishop, be and they are hereby appointed commissioners
in the place of those mentioned in the act of eighteen
hundred and forty, chapter two hundred and fifteen, and
its supplements, and that the said commissioners hereby
appointed, or a majority of them, have full power and
authority to expend all the money which has been or
may be raised under and in virtue of the said act, in
making a ditch or canal of such dimensions as they
may deem expedient, from some point in the Pocomoke
river, to Birch Branch, or tributary of St. Martin's
river.

Power to contract.
|
SEC. 2. And be it enacted,
That the said commissioners
or a majority of them, shall have full power
and authority to contract with any persons through
whose lands the said ditch or canal may pass, for all
the lands necessary to make said ditch or canal, and if
the said commissioners shall be unable to acquire the
necessary lands by contract with the owners by reason
