Compensation
of clerks.
|
SEC. 4. And be it enacted,
That the Comptroller
of the Treasury shall, from time to time, limit and fix
the number and compensations of the assistant clerks or
deputies to be employed by any clerk or register as
aforesaid; and no account for the compensation for services
of any assistant clerk, deputy, or other persons
employed in any duties pertaining to the offices of the
aforesaid clerks and registers, shall be allowed until
such assistant clerk or other person employed shall
have certified, on oath or affirmation, that the same
services have been performed, that he has received
the full sum therein charged, to his own use and benefit,
and that he has not paid, deposited or assigned, nor
contracted to pay, deposite or assign, any part of such
compensation to the use of any person, nor in any
way, directly or indirectly paid or given, nor contracted
to pay or give, any reward or compensation for his office
or employment, or the emoluments thereof.

Penalty for
false swearing.
|
SEC. 5. And be it enacted,
That any clerk or register
as aforesaid, who shall be guilty of false swearing, in
taking the oath at the rendition of his accounts, as required
by this act, to be prescribed by the Comptroller
of the Treasury, with the intention to deceive and defraud
the Treasury of this State, shall be guilty of
perjury and liable to the same prosecution and penalty
inflicted for like offences, to be tried and adjudged in
any court of this State having jurisdiction thereof; and
shall moreover, on conviction thereof, be judged as
having vacated his office, and pay a fine not exceeding
five hundred dollars; and it shall be the duty of the
Comptroller of the Treasury, whenever, in his opinion,
the said offence has been perpetrated as aforesaid, to
direct the State's attorney of the county or city within
which the same has occurred, to prosecute the offender.

Official bonds
answerable.
|
SEC. 6. And be it enacted,
That the official bonds
of said clerks and registers shall be answerable for the
emoluments of their offices, over and above twenty-five
hundred dollars, as provided for by this act, and that
upon failure or neglect of any of the aforesaid clerks or
registers, to pay on account for the same, in the manner
prescribed by this act, it shall be the duty of the Comptroller
of the Treasury to direct the bonds of such
offending clerk or register to be put in suit, and shall,
moreover, on conviction for every such refusal or neglect
as aforesaid, pay to the State a fine not exceeding one
thousand dollars.
