to preserve order, punish contempts and enforce
obedience to the proper order and adjudications of the
said commissioner, as are now possessed by any court
of record of this State.

Duty to keep
a docket.
|
SEC. 2. And be it enacted,
That it shall be the
duty of the commissioner of the land office to keep a
docket, in the form of the docket of the chancery court,
of all disputed cases, effecting the title to lands, transcripts
of which shall be evidence of the proceedings
thereon, and that all papers filed in such cases shall,
with the proceedings and adjudications and order of the
commissioner of the land office be duly recorded, and
subject to the payment of such fees not enumerated in
the fee bill of the land office, as have been heretofore
charged in the chancery court for like proceedings.

Process relating
to proceedings.

SEC. 3. And be it enacted,
That the process relating
to proceedings in the land office, shall hereafter issue
under the seal of the land office of Maryland, attested
by the commissioner of the land office.

Right of appeal.

SEC. 4. And be it enacted,
That any parties aggrieved
by any judgment, final order or determination
in any case effecting the title to lands, shall have full
power and right to appeal from such judgment, order or
determination, to the court of appeals; Provided, that
such appeal shall be made within nine months from
the date of such judgment, order or determination, the
party appealing filing at the time of such appeal, his
reasons for such appeal; And provided, further, that no
such appeal shall stay proceedings, unless bond and
security be given in the manner now practised in the
chancery court.

SEC. 5. And
be it enacted, That all monies now
required to be paid to the Treasurer, on account of the
public lands, be hereafter paid to the commissioner of
the land office, whose receipts therefor shall be a good
acquittance to the parties paying the same; and that the
commissioners of the land office shall keep an entry of
all such payments in a proper book kept for the purpose;
and that he account monthly with the Comptroller, and
pay over to the Treasurer, on oath, all such monies
so received, first deducting therefrom twenty-five per
centum as a compensation for his trouble; the said commissioner
first giving bond in the penalty of two thousand
dollars for the faithful performance of this duty,
to be approved by the Governor and kept in the State
Department.

That the commissioner
of the land office shall record the case of Andrew and
William H. Ellicott against Hugh Gelston and others
