     SEC. 2.  And be it enacted, That the Treasurer be,
and he is hereby directed to pay upon the warrant of
the Comptroller, out of any money not otherwise appropriated,
and after the said work shall have been executed,
to the State's wharfinger, such sum or sums as
may be necessary to carry into effect the first section of
this act and to repair the pier at said wharf; Provided,
the same shall not exceed the sum of four hundred dollars.
     Authority to
pay.
     SEC. 3.  And be it enacted, That the said work shall
not be commenced before the first day of June next,
but as soon thereafter as possible.

                                   CHAPTER 68.

                 AN ACT relating to Writs of Diminution.

21, 1853.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That upon every writ of diminution that
shall hereafter be issued by the Court of Appeals of
this State, to any inferior court, it shall be the duty of
such inferior court to certify and return only such parts
of the record or proceedings as shall have been omitted
in the transcript or transcripts therefore transmitted to
the Court of Appeals.

     SEC. 2.  And be it enacted, That every application
for a writs of diminution, shall contain a specification
in writing, of the parts of the records or proceedings requisite
to be supplied, which shall also be incorporated
in the writ of diminution for the guidance of the inferior
court.

     SEC. 3.  And be it enacted, That the issuing of a
writ of diminution shall not delay the hearing in the
Court of Appeals of any cause, in case the return thereto
be made before the said cause, shall be called for
hearing unless for good cause shewn.
