on the Lonaconing Rail Road, or on the Baltimore and
Ohio Rail Road, or on the Chesapeake and Ohio
Canal, and said company are hereby authorised to acquire
by purchase, the lands and materials necessary for
the construction of such rail road, or in case the land
necessary for an outlet from the mines of said company
cannot be acquired by purchase then said company shall
be, and are hereby authorised to condemn the same by
a jury in the manner provided in the charter of the
Metropolitan Rail Road Company, passed at the present
session of the General Assembly, the condemnation
to be made by a jury and other appropriate officers
of Allegany county, and on payment or tender of the
valuation so to be made, the said company may enter
upon and hold the lands so to be condemned for the
purposes aforesaid; Provided, that nothing in this act
shall be so construed as to authorise said company to
hold any mines or other real estate except as deposits
for its coal or iron or to construct any rail road except
within the limits of Allegany county, or so to construct
their road as to cross or in any manner damage the
rail road of any other company constructed or being
constructed at the date of the passage of this act.

Proviso.
|
SEC. 6. And be it enacted,
That said company
shall not be authorised to exercise any banking privilege,
or to make any note, scrip, certificate or other issue
intended to circulate as currency; and this act may be
altered or repealed at any time by the General Assembly
of Maryland.

SEC. 7. And be it enacted,
That this act shall go
into effect from the date of its passage.

AN ACT to authorise the School commissioners of
Frederick county to make a division of School District
number sixteen, of said county, into two separate
School Districts.

WHEREAS, It is represented, that
the boundaries of
school district number sixteen, of Frederick county
are too large and inconvenient for the proper enjoyment
of the privileges intended to be afforded; Therefore,
