CHAPTER 405.
AN ACT in favor of William C. Pierce, of Montgomery
county.

WHEREAS, It has been represented
to this General
Assembly that William C. Pierce, of Montgomery
county, has been aggrieved by a decision of the county
commissioners of Montgomery county, in the matter of
the petition of David Brady and others, for opening
and laying out a public road in said county; And
whereas, the said William C. Pierce has been refused
the right of appeal from the decision of the said commissioners,
upon the ground of an informality in his
prayer for an appeal; And whereas, it is represented
that justice required that said proceedings should be revived
by the circuit court of Montgomery county;
Therefore,

Preamble.
|
Be it enacted by the General
Assembly of Maryland,
That the county commissioners of Montgomery county
be, and they are hereby authorised and required to
cause the record of the proceedings mentioned in the
preamble of this act to be transmitted to the circuit court
of Montgomery county at the next term thereof, in the
same manner and to the same effect as if an appeal had
been regularly taken under existing laws, and the judge
of the circuit court of Montgomery county is hereby
authorised to hear and determine said cause as all other
case of appeals are heard and determined under existing
laws.
