                           CHAPTER 373.

AN ACT to amend the charter of the Union Plank or
     Turnpike road company, passed December session
     eighteen hundred and forty-nine, chapter three hundred
     and fifty-eight.

27, 1853.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That in case of a vacancy or vacancies
occurring by death, resignation or any other cause in
the board of directors of said company during the year
for which they are elected, the remaining directors may
supply said vacancy or vacancies, by electing such person
or persons to supply said vacancy or vacancies as
may be qualified to serve as directors according to the
terms of qualification prescribed by the original charter
for directors, to serve until the next annual election of
directors.

     SEC. 2.  And be it enacted, That the Union Plank
or Turnpike road company are hereby authorised
and empowered to construct their road on the bed of
the Westminster road, whenever they may deem it
necessary for the purposes of said company, to use the
same without the consent of the county commissioners
as required in the sixth section of the act to which this
is amendatory, subject to all the conditions contained
therein for the condemnation of land and materials, and
the assessment of damages.

     SEC. 3.  And be it enacted, That the Union Plank
or turnpike road company are hereby invested with full
authority and power to use the bed of the road formerly
known as the Washington and Rockville Turnpike
road, according to the terms, and subject to the conditions
of the charter of the Union Plank or Turnpike
road company; And provided further, that the act repealing
this charter of the said Washington and Rockville
turnpike company, passed by the General Assembly
at January session, eighteen hundred and fifty-three,
shall not in any manner effect or impair the rights of
said company within the limits of the District of Columbia,
anything in any act of Assembly to the contrary
notwithstanding.
