said company shall not be authorised to issue any certificate,
note, token, scrip or other devices to be used as
currency.

     SEC. 3.  And be it enacted, That the mayor, aldermen
and common council of Frederick, and the commissioners
for Frederick county, be, and they are
hereby respectively authorised, in their discretion, to
subscribe for such number of shares, not exceeding two
hundred, of the capital stock of said company, or such
less number of shares as they may deem expedient and
proper, in the name and for the benefit of said town or
county, as the case may be; and the said county commissioners
and the mayor, aldermen and common
council of Frederick may be represented at all meetings
of the stockholders of said company, by such person or
persons as may be duly authorised by them.

     SEC. 4.  And be it enacted, That in the condemnation
if such lands and materials or other rights necessary
to be used in the making of said canal and other
works connected therewith, or for the purchase, use or
occupation of the same, the like proceedings in all respects,
shall be had as by existing laws are required for
the condemnation and assessment of lands, rights and
materials for the use of and construction of the Chesapeake
and Ohio canal, and the works appurtenant
thereto; but it shall, nevertheless, be lawful for the
said company to enter upon such lands, and take and
use such materials, after having first made payment or
tendered payment for the same, at the valuation assessed
thereon as above prescribed; and the provisions of
the fifteenth section of the said original act, so far as
the same may be inconsistent with this act, be, and
the same are hereby repealed.
