shorten the distance, making an artificial bed of stone
or gravel, not less than sixteen feet in breadth.

     SEC. 5.  And be it enacted, That the said company
shall cause said road to be completed within five years
from the passage of this act, otherwise the right of said
stockholders shall revert to the State of Maryland.
     When to be
completed.
     SEC. 6.  And be it enacted, That the commissioners
board of Washington county be, and they are hereby
authorised to subscribe for such number of shares, not
exceeding one hundred, in the capital stock of the
company hereby incorporated, that they may deem
expedient and proper to be subscribed for, in the name
and for the benefit of Washington county, and to be
represented at all meetings of the stockholders of said
company, by the county commissioners for the time
being, or by such person or persons as may be duly
authorised by them.

     SEC. 7.  And be it enacted, That the said company
shall have the right to erect upon said road two toll
gates; Provided, said gates be not erected within one
mile and a half from the town of Hagerstown, and one
mile and a half from the town of Smithsburg; and they
are hereby authorised to appoint such, and so many,
toll gatherers as they shall think proper, who are empowered
to collect and receive of, and from all and
every person and persons using said road, the tolls and
rates hereinafter mentioned; and to stop any person
riding, leading or driving any horses, cattle, sheep,
sulky, chaise, phæton, coach, coachee, cart, wagon,
sleigh, sled, or other carriage of pleasure or burthen,
from passing through said gate, until they have respectively
paid the same; that is to say, the following
sums of money, and so in proportion, for any greater
or lesser number of sheep, hogs or cattle, namely: for
every score of sheep, five cents; for every score of hogs,
five cents; for every score of cattle, ten cents; for every
horse and his rider, or led horse, three cents; for every
sulky or chaise, with one horse and two wheels, five
cents; for every chariot, coach, stage, wagon, phæton
or chaise, with two horses and four wheels, ten cents;
for either of the carriages last mentioned, with four
horses, twenty cents; for every other vehicle, by whatever
name it may be known, the like sums, according
to the number of wheels, and horses drawing the same.

     SEC. 8.  And be it enacted, That this company,
during the construction of the turnpike road as aforesaid,
may prevent travel upon said road, when in their
judgment, the use of the same will work an injury to
the road, and as soon as one half of said road shall have
