CHAPTER 238.
AN ACT relating to Habeas Corpus.
|
Jurisdiction.
|
SECTION 1. Be it enacted
by the General Assembly
of Maryland, That the jurisdiction of the several circuit
courts, and the judges thereof, out of court, of the
court of common pleas of Baltimore city, and of the
judge thereof out of court; of the superior court of Baltimore
city, and of the judge thereof out of court; of
the criminal court of Baltimore, and of the judge thereof
out of court, shall extend over the whole State in all
matters relative to habeas corpus.

Writ of
habeas corpus
may at any
time be granted.
|
SEC. 2. And be it enacted,
That the writ of habeas
corpus, at any time whether in term or vacation, may
and shall be granted by any of said courts, or by any
of the judges of said courts, out of court, in all cases
where it may not be granted by any court or judge of
this State, and the proceedings, including the application
or the writ, and the granting and issuing of the
same, shall be such as are now required and provided
in cases where the writ may issue independent of this
act.

That this act shall take
effect from the day of its passage.
