of Samuel Dunnock, late of said county, deceased,
the orphan's court of said county be and they are hereby
authorised and empowered to make a distribution of the
personal estate of the said Samuel, among the persons
entitled to the same according to the principles of law
and the true construction of said will; Provided, the
said petition shall be filed before the first day of August
next.

Notice to be
given to persons
interested.

SEC. 2. And be it enacted,
That it shall be the duty
of the said court before proceeding to make distribution
as aforesaid, to give at least ten days notice in writing
to each person interested, of the day on which said
distribution will be made, which said notice shall be
served by the sheriff of the counties respectively in
which said persons may reside.

Copy of distribution
heretofore made
to be received
as evidence.

SEC. 3. And be it enacted,
That the copy of the
distribution heretofore made on file in the office of the
clerk of the circuit court for the county aforesaid, shall
be taken and received as prima facie evidence of the
description and amount of the personal estate of the said
Samuel to be distributed as aforesaid.

Right of appeal.
|
SEC. 4. And be it enacted
That any party feeling
himself or herself aggrieved by the decision of the court
aforesaid in the premises, may appeal as in other cases
from the decision of the orphan's court.

SEC. 5. And be it enacted,
That this act shall take
effect from its passage.

CHAPTER 177.
AN ACT relating to Free Negroes in Cecil county.

Lawful to
leave the
State.
Provisoes.
|
SECTION 1. Be
it enacted by the General Assembly
of Maryland, That it shall be lawful for any free
negro, whilst in the employ of any white person in
Cecil county, to leave the State of Maryland and return,
without being subject to the penalties imposed on free
negroes emigrating into this State, by the act of eighteen
hundred and thirty-nine, chapter thirty-eight; Provided,
that such free negro shall leave the State only
for the purpose of transacting business for his white
employer; And provided, further, that it shall not be
lawful for such free negro to remain out of the State
