dollars of the surplus funds of said primary school,
and dispose of the old school house at private or public
sale, and to appropriate the proceeds arising therefrom,
towards building a new one, if they, or a majority of
them, deem it proper to do so.
     Authority to
levy.
     SEC. 4.  And be it enacted, That the said trustees or
a majority of them, are hereby authorised and empowered
to levy from time to time an additional tax upon
the taxable property of said primary school district, as
they may deem most prudent and proper for the purpose
of reimbursing the hundred dollars so used out of
the surplus funds of said school, and to do and perform
all other acts for the management and good government
of said school.
     Inconsistent
acts repealed.
     SEC. 5.  And be it enacted, That all acts of part of
acts inconsistent with the provisions of this act, be and
the same are hereby repealed, and that this act shall
take effect from its passage.

                           CHAPTER 165.

AN ACT for the benefit of the " Redemptorists" and
     the congregations under their pastoral charge, in relation
     to a burying ground lot.
Preamble.
     WHEREAS, The " Redemptorists" and the German
congregations under their pastoral charge, have by their
petition to this General Assembly, represented that they
have purchased a grave yard within the limits of the
city of Baltimore, for the interment of their deceased
brethren; and that several streets have been located
through said grave yard, which if opened, would produce
great inconvenience; And whereas, the said petitioners
have further represented the said grave yard to
be remote from improvements and improving parts
of said city; And whereas, their petition seems reasonable
and ought to be granted; Therefore,
Not lawful to
open streets
without sanction
of General
Assembly.
     Be it enacted by the General Assembly of Maryland,
That it shall not be lawful to open any street,
lane or alley through the burial grounds of the Redemptorists,
situated in the city of Baltimore on Loney's
lane, without the sanction first had of the General Assembly
of Maryland; Provided, that nothing herein
contained shall be so consumed as to prevent the opening
