166                                        LAWS OF MARYLAND.
     Judgment to
remain conclusive.
     SEC. 2.  And be it enacted, That the judgment of
the court, heretofore rendered, shall stand and remain
as conclusive, except as to the question of damages or
compensation to the said petitioners, and that the commissioners
of the county shall have five days notice of
the hearing of the said cause before the circuit court.
In force.
     SEC. 3.  And be it enacted, That this act shall take
effect from the date of its passage.

                           CHAPTER 145.

AN ACT to authorise the School Commissioners, of
     Frederick county, to establish a new School District
     in said county.
Preamble.
     WHEREAS, It is represented that by the original division
of primary school districts, in Frederick county,
the people of a certain locality, in consequence of their
remoteness to the nearest school, and the bad condition
of the roads leading thereto, are not only greatly inconvenienced
thereby, but in many instances entirely deprived
of the benefit growing out of the free system of
education; Therefore,
     Authority to
lay out new
school district.
     SECTION 1.  Be it enacted by the General Assembly
of Maryland,
That the school commissioners of Frederick
county, be, and the same are hereby authorised, in
their discretion, at their next regular meeting, to lay
out and establish a new school district in that part of
the county lying between numbers thirty-six, thirty-nine,
forty-one and eighty-one, or better known as
Emmittsburg, the Ridge, Stony Branch and Clairvaux
school districts, to be known as school district number
one hundred and three.
     Entitled to
school fund.
     SEC. 2.  And be it enacted, That the new school
district, so laid out, shall be entitled to a just and reasonable
proportion of the school fund; shall elect its
own trustees, and in all other respects shall have the
same rights, privileges and immunities, as are now enjoyed
by the other school districts of the county.
In force.
     SEC. 2.  And be it enacted, That this act shall take
effect from the date of its passage.
