counties are hereby authorised and required, on receiving from
the commissioners an account, on oath, of the said expenses, including
an allowance of two dollars per day to the commissioners
for their services, to levy the same in the proportion before
stated, on the assessable property of said counties, to be
collected as other county charges are now collected. |

3. And be it enacted, That the said
commissioners or a majority
of them shall value and ascertain the damage that may be
sustained by any person or persons through whose land the said
road may be made to pass, taking into consideration the advantages
and disadvantages (if any) and the damages so ascertained,
shall be levied and assessed as other county charges in said
counties are, and shall be paid by the counties wherein such damages
may be sustained. |

4. And be it enacted, That the said
commissioners before they
proceed to act shall take an oath, or affirmation, before some
justice of the peace, that they will, without favor, partiality or
prejudice, assess the damages sustained by the person through
whose lands, the said road may pass. |

or parts of acts inconsistent
with or contrary to the provisions of this act, be and the
same are hereby repealed. |

CHAPTER 108.
An act to introduce a supply of Water into the Town of Westminster,
in Frederick county. |

WHEREAS, The citizens of Westminster in Frederick
county,
gave petitioned this General Assembly, that an act may be
passed to incorporate a company, for the purpose of introducing
a supply of wholesome water into the town of Westminster.
And whereas, the health and convenience of the inhabitants as
well as security of property against the ravages of fire, would be
greatly promoted thereby; Therefore, |
Preamble. |
SEC. 1. Be it enacted by the General Assembly
of Maryland,
That a company shall be established in the town od Westminster,
for said purpose, the capital stock whereof, shall be three
thousand dollars, divided into three hundred shares; and that
subscriptions to constitute said stock, shall on the first Monday
of May next, be opened in said town, under the superintendence
of the following commissioners, or a majority of them,
viz: Abraham Wampler, John Fisher, and Jacob Yingling; and
that the subscription books shall be kept open for the space of
two days; and if subscriptions be taken to the amount of one
half or more of the capital, then the said company shall be authorised
to go into operation; and the books may be re-opened
for the completion of said capital, at the pleasure of said company |
