Hoskin claiming damages sustained by the road laid out from
Belle Air to the Baltimore county line; through the lands of the
said Nathaniel Hoskin, shall extend to him the benefit of an act
relating to public roads in the several counties therein mentioned,
passed February the eleventh, eighteen hundred and twenty-two,
chapter one hundred and fifty-two. |

CHAPTER 54.
An act to authorise John McKnight to cut a canal therein mentioned in
Dorchester county. |
Preamble. |
WHEREAS John McKnight of Dorchester county has petitioned
to the general assembly of Maryland, for a law to enable him to
cut a canal from Staplefor creek to the main road in DOrchester
county: Therefore, |
Authority
granted. |
Sec. 1. Be it enacted by the General Assembly
of Maryland,
That John McKnight, of Dorchester county be, and he is hereby
authorized to excavate, cut and make a canal from Staplefor
creek to the main road, of such width and depth as shall be in
the opinion of said petitioner most conducive to the object he
has in view. |
Dirt to be
thrown. |
2. And be it enacted, That the said
John McKnight shall
cause the dirt coming out of the proposed canal in excavating
the same, to be thrown as nearly equal on both sides of the said
canal as possible, so as to prevent the water from rising and
overflowing the marsh through which the said canal shall pass. |
Expence and
damages. |
3. And be it enacted, That the aforesaid
John McKnight,
shall be at all and every expense in cutting or excavating the
aforesaid canal, and shall pay for all damages that may arise to
the orphan or orphans, or to either of their respective guardians,
as the case may be; which damages shall be valued by
two discreet and disinterested persons, one to be chosen by the
petitioner and the other by such person as may have the management
of the orphan or orphan's through whose marsh the
said canal is to be cut or excavated. |
Right vested. |
4. And be it enacted, That the aforesaid
John McKnight, shall
be and he is hereby vested with the exclusive and sole right of
using said canal, and that it shall not be lawful for any person
to use said canal without the permission of said John McKnight,
or impede him in the full enjoyment and use of it, any law
usage or custom to the contrary notwithstanding. |
