            JOSEPH KENT, ESQUIRE, GOVERNOR.

any scholar or scholars, under a bargain or arrangement with
said commissioners, at the rate aforesaid, for each and every
scholar so taught for the time said scholar has actually attended
school, provided said commissioners shall be satisfied that
said teacher or teachers have done their duty, and it shall be the
duty of each and every teacher, when they render their accounts
to the commissioners, to attach thereunto an affidavit or affirmation
made before a justice of the peace in the usual form, stating
that the same is just and true to the best of their knowledge and
belief.

    5.  And be it enacted, That the said commissioners shall have
authority to call on the treasurer at the expiration of each and
every year, or as soon thereafter as convenient, for such portion
of the school fund as may be due to the county, either as their
annual share of said fund under the law of 1813, chapter 122, or
as dividend or interest on stock, of the different banks in which
investments have been made of any part of parts of the school
fund belonging to said county, which sum or sums of money
the treasurer shall forthwith pay to the order of the president of
said board of commissioners.

    6.  And be it enacted, That after the first meeting directed by
this act, to take place on the second Monday of March next, it
shall be the duty of the commissioners to meet annually in the
town of Rockville, on the second Monday of December in each
and every year, or as soon thereafter as they conveniently can, to
make such arrangements, as from time to time may be necessary
to carry this act into effect, and said board of commissioners
may confide to any one or more of their members, such powers
and duties as they may conceive necessary to carry into effect
this act or any part thereof, or they may appoint agents not
members of the board, to assist in carrying the same into effect,
subject always to the regulations and restrictions in this act
contained.
Quorum.     7.  And be it enacted, That it shall require the presence of
five commissioners to form a board for the purpose of drawing
on the treasurer, or for the transaction of any other business of
importance.
    Non-attendance.     8.  And be it enacted, That if any commissioner or commissioners
appointed, or who shall hereafter be appointed under the
provisions of this act, and who shall accept said appointment,
shall be absent at two successive annual meetings of the board
of commissioners, he or they shall be considered as having resigned
and an appointment or appointments, shall be made in
their places in the manner heretofore directed by this act for the
filing of vacancies, unless they shall within one month from
the time of the last delinquency, appear before the orphans' court,
and assign some sufficient cause, as sickness or the like, for said
absence.
$2 per diem.     9.  And be it enacted, That each commissioner shall be entitled
to receive two dollars per day for his attendance at each
