Whereas, Said corporation is seeking to renew its
charter and obtain from Congress the right to condemn
the property of the Chesapeake and Ohio Canal Com-
pany and to place a bridge over the Canal in such form
as would prevent the use of the Canal for a railroad as
well as a waterway, which would tend to greatly depre-
ciate the value of the property of the Canal Company
and be a grievous wrong to the people of Maryland;
therefore

Be it resolved by the General Assembly of Mary-
land, That the Senators from this State be instructed
and the Representatives in Congress be requested to
prevent the extension of the charter of the Washing-
ton and Western Maryland Railroad Company, unless
it shall be amended so as to prevent said railroad com-
pany from occupying, using or acquiring the property
of the Chesapeake and Ohio Canal Company

And be it further resolved, That a copy of these
resolutions be forwarded to the Senators and Repre-
sentatives from Maryland in the Congress of the United
Stated.

SENATE JOINT RESOLUTIONS

Requiring that the Attorney General of Maryland
be instructed to enjoin all persons from occupying and
using the property of the Chesapeake and Ohio Canal
Company; and also to bring to the attention of the
Circuit Court for Washington county the action of the
trustees now in charge of said property, and to pray
said court to pass an order on said trustees directing
them to prevent the misuse of said Canal Company.

Whereas, The Chesapeake and Ohio Canal Com-
pany, the controlling interest of which is owned by
the State of Maryland, has been by a decree of the
Circuit Court for Washington county placed in the
hands of the trustees of the bondholders of 1844 for a
term of years; and

Whereas, Said trustees are simply the representa-
tives of the Baltimore and Ohio Railroad Company;
and

Whereas, The Baltimore and Ohio Railroad Com-
pany is engaged in constructing a railroad along the
banks of the Chesapeake and Ohio Canal in the Dis-
trict of Columbia, and have taken possession without
