thereto further sections, and to re-enact the same

|
|
with amendments, so as to elect the Councilmen of
|
|
|
|
Hagerstown by the voters in the respective wards of
|
|
|
|
said town, and to authorize the Justices of the Peace
|
|
|
|
to enforce the ordinances relative to crimes and pun-
|
|
|
|
ishments ; " be, and the same are hereby repealed,
|
|
|
|
and the following enacted in lieu thereof:
|
|
|
|
SEC. 109. The inhabitants of Hagerstown, in
|
|
|
|
Washington county, Maryland, are a corporation
|
|
|
|
by the name of " The Mayor and Council of Ha-
|
|
|
Corporation.
|
gerstown," and by that name shall have perpetual
|
|
|
|
succession ; may sue and be sued, may have and use
|
|
|
|
a common seal, and possess such other incidents and
|
|
|
|
attributes as attach by law to a municipal corpora-
|
|
|
|
tion.
|
|
|
Survey.
|
SEC. 110. The survey made under the authority
|
|
|
|
of the Mayor and Council of Hagerstown, by Sam-
|
|
|
|
uel S. Downin, surveyor, and adopted by ordinance
|
|
|
|
passed on the eleventh day of June, in the year
|
|
|
|
eighteen hundred and seventy-five, and entered upon
|
|
|
|
the records of their proceedings, and recorded in the
|
|
|
|
office of the Clerk of the Circuit Court for Wash-
|
|
|
|
ington county, in Liber number seventy-three, folios
|
|
|
|
four hundred and seventy-seven and four hundred
|
|
|
|
and seventy-eight, one of the Land Records of Wash-
|
|
|
|
ington coiinty, Maryland, and the map of Hagers-
|
|
|
|
town, inserted in said book of records, next preced-
|
|
|
|
ing the record of said survey, shall constitute the
|
|
|
Bounds and
|
bounds and limits of said town, and the said map
|
|
|
limits of town
|
and record of survey shall be received as evidence
|
|
|
|
of the limits and boundaries of the said town, and
|
|
|
|
the wards, lots, streets, lanes and alleys thereof.
|
|
|
|
Provided, however, that for sanitary and police pur-
poses the Mayor and Council of Hagerstown shall
|
|
|
|
have and exercise full power and control for a dis-
|
|
|
|
tance of one-half mile in every direction from said
|
|
|
|
corporate limits.
|
|
|
|
SEC. 111. The male citizens of Hagerstown of the
|
|
|
|
age of twenty-one years and upwards, who have re-
