wanted for the site of the said road or roads, or for

the erection of works necessary for said road or roads,

or for any other purpose necessary for the con-

struction, repair and running of said road or roads,

or its works, and may make and construct all works

whatsoever necessary or expedient, in order to the

proper completion of said road or roads.

SEC. 10. Be it enacted, That if any person shall

wilfully, by any means whatsoever, injure, impair or

destroy any part of said railroad, or any part of the

buildings or works, vehicles, machinery or property
of said company, every such person so offending
shall for every such offence forfeit and pay to the

company the actual damages sustained, which may

be recovered by the company as any other debt or

damages, and also be subject to indictment in the

Circuit Court in Baltimore county, or if the offence

be committed in Baltimore city, in the Criminal

Court thereof, and, upon conviction, be fined and

imprisoned, in the discretion of the court.

SEC. 11. And be it enacted, That this act shall take

effect from the date of its passage.
