CHAPTER 143.

AN ACT to repeal the act passed at the January

session of the General Assembly of Maryland,

eighteen hundred and seventy-six, chapter twenty,

entitled "An act to empower the Mayor and City

Council of Baltimore to purchase, lease or con-

demn lands for public parks or squares within the

limits of said city," and to revise and amend sec-

tion eight hundred and thirty-seven of the Public

Local Laws, article four, City of Baltimore, and

to make valid proceedings had for the condemna-

tion pf ground for a bublic square.

Whereas grave doubts have been expressed as to

the constitutionality of the Act of the General As-

sembly of Maryland, passed at the January session,

eighteen hundred and seventy-six, chapter twenty,

entitled " An act to empower the Mayor and City

Council of Baltimore to purchase, lease or condemn

landa for public parks or squares within the limits of

said city; and whereas, in the event of proceedings

being had under said act, the title to lands would be

affected by litigation based on the alleged invalidity

of said act ; wherefore, to avoid the possibility of any

such result :

SECTION 1. Be it enacted by the General Assem-

bly of Maryland, That the said act of the session
of eighteen hundred and seventy-six, chapter twenty,

be and the same is hereby repealed.

SEO 2. And be it enacted, That section eight hun-

dred and thirty-seven of article four of the Public

Revived.

same is hereby revived and amended so as to read as

follows:
