the ways or means so offending, shall for every such offence,


respectively, forfeit and pay to said company any sum less


than ten dollars, to be sued for and recovered with cost of


suit, before any justice of the peace in like manner as debts


of a similar amount may be sued for and recovered, and


with a right of appeal as in such cases.


SEC. 11. And be it enacted, That the County Commis-


sioners of Prince George's, Howard and Baltimore Counties

Guaranteed
bonds

are each hereby authorized and empowered in their discretion


to guarantee any bonds which may be issued by said turn-


pike company, and secured by mortgage as provided for in


section third of this act, not exceeding five thousand dollars


per mile, provided that said bonds when guaranteed, shall


not bear a larger rate of interest than six per centum per


annum, and said bonds shall be free from county and


municipal taxation, and sold for not less than their par


value, and the several boards of county commissioners are


authorized to make the necessary levy to pay any annual


interest, and provide for the payment of the principal.


SEC. 12. And be it enacted, That said company shall have


the power to build, erect, maintain and operate an electric


or other such tramway along said road as may be hereinafter


provided the running thereof shall not interfere with the

gravel or other hard substance ; and said company shall also


have the power to contract with any electric or other rail-


road company for the use of a portion of the bed of said


turnpike, take stock in any such, or make any reasonable


contract for the purpose ; and provided further that the


tramway company shall be limited in its transit rates


between the two cities and on any part of the route, to one


and one-half cents per mile, with the lowest fare between


any two points to be five cents; and provided further that


said company shall be authorized to use any motor power on


said tramway.


SEC. 13. And be it enacted, That no toll shall be collected

rated, nor shall any tollgate be erected within the corporate


limits of any such town.

Effective.

SEC. 14. And be it enacted, That this act shall take effect


from the date of its passage.
