in their respective counties, and, upon the recommendation
of such county commissioners, the governor shall appoint
and commission such officers, who, when qualified, shall
have all the powers and perform all the duties required of
other officers of the State Fishery Force, provided, however,
that all expense of providing boats and paying the salaries
of such officers shall be paid by the clerk of the Circuit
Court of the county upon the certificate of the said county
commissioners, out of the moneys received by the said clerk
under section fifteen of this article before the same is paid
over to the school commissioners as therein provided.

CHAPTER 644.


AN ACT to refund to license measurers of oysters in the


city of Baltimore, the license fees paid by them to the


clerk of the Court of Common Pleas of Baltimore City in


the years 1888, 1889, 1890, 1891 and 1892.


WHEREAS by an act of the General Assembly of Mary-


land, acts 1874, chapter 221, entitled "An act to repeal

Preamble.

chapter one hundred and ninety-three, of the acts passed at


January session eighteen hundred and seventy -two, and to


re-enact the same with amendments, so that oysters sold in


the shell at Baltimore, Crisfield and at all packing estab-


lishments shall be measured in an iron measure," which act


of Assembly was not re-enacted by the Code of Laws of


1888, and which act of 1874, chapter 221 has been claimed


to be in force and under which license fees have been paid


by the measurers of oysters in the city of Baltimore, to the


clerk of the Court of Common Pleas of the said city, for the


use and benefit of the State of Maryland for the years 1888,


1889, 1890, 1891 and 1892 ; therefore,


SECTION 1. Be it enacted by the General Assembly of
