enacted by the act of 1890, chapter 498.


SECTION 1. Be it enacted by the General Assembly of


Maryland, That section fifty-nine of article twenty-seven,

498, be and the same is hereby repealed and re-enacted so


as to read as follows ;


SEC. 59. Any person, his aiders, abettors, and counsel-


lors, who shall be convicted of the crime of breaking into,

then being upon the tracks of any railroad company in


this State shall, in the discretion of the court, be imprisoned


in the penitentiary not less than two nor more than ten
