of one hundred and fifty dollars, and on the applicants pro-


ducing to the said mayor, counsellor and aldermen the


receipt or a certificate of said collector and treasurer, show-


ing the payment by the applicant of the fee for the class of


business for which said mayor, counsellor and aldermen has


decided to grant him, her or them a license said mayor,


counsellor and aldermen shall issue such license ; and the


license when issued shall designate the class or character of


business for which the license is issued, and any person


obtaining a license of the latter class who shall sell distilled


liquors or any mixture thereof or any liquors containing


more than fifteen per cent, of alcohol, shall be liable to the


same penalties as if the sale had been made without any


license at all ; provided that any retail grocer doing busi-


ness within said city who shall make application for a license


to sell vines or other liquors in unbroken packages or in


quantities not less than one quart and in no case to be


drunk on the premises, may be licensed by said mayor,


counsellor and aldermen to do so on complying with the


conditions of this sub-title and paying therefor the sum of


one hundred dollars a year.


SEC. 184 O. Druggists and apothecaries in said city shall


not be required to obtain license under the provisions of this

sub-title, but they shall not sell intoxicating liquors, nor


compound or mix any composition thereof except upon the


written prescription of a regular physician or dentist ; nor


more than once on any one prescription of such physician


or dentist ; and every druggist or apothecary in said city


shall keep a book for the record and enter therein the date


of every sale of intoxicating liquor made by him, the person


to whom sold, the kind, quantity and price thereof, and the


purpose for which it was sold, and such book shall be at all


times open to the inspection of said mayor, counsellor and


aldermen, or of any person designated and authorized by


them to make such inspection, and shall be produced before


the said mayor, counsellor and aldermen when required;


and any failure to comply with the provisions of this section


shall render such druggist or apothecary so failing, liable


to the same penalties as if he had sold intoxicating liquors


without a license.


SEC. 2. And be it enacted, That this act shall take effect

Effective.

from the date of its passage.
