672 LAWS OF MARYLAND.

other legal disability, or out of said county, the said com-
pany may proceed to condemn and acquire the use of the
same for the purposes of said electric railway or railways or
for the purposes of the motive power thereof (provided that
the right of condemnation shall not apply to any water
power or other property adjacent thereto and necessary
therefor used in part or in whole for manufacturing pur-
poses) in the manner provided for by the Code of Public
General Laws article 23, section 167 inclusive, so far as the
same may be applicable to said corporation and provided
further that before said company shall lay the tracks for
said railway along any of the routes that may from time to
time be determined upon by it, the said company shall file
with the county commissioners of said county, a written
description of the particular route selected as far as the
same shall effect the highways of said county and the said
commissioners shall thereupon, at the expense of said com-
pany, cause to be published, once a week for two successive
weeks in each of two newspapers published in said county, a
notice describing the particular highways sought to be used
by said company, and specifying some day not less than
five days after the publishing of the last notice herein
required, on which the said application shall be considered,
and if said commissioners shall determine that the building
of the proposed railway, over each particular route that may
from time to time be selected and for which permission may
from time to time be asked, shall be for the benefit of the
public, the said commissioners may grant the permission
sought, and if they shall determine that any such permis-
sion sought if granted will not result in benefit to the pub-
lic the same shall be by them refused, and said commis-
sioners shall attach to the granting of any such permission,
such reasonable regulations as to the manner of construct-
ing any of said railways and the time in which the same
shall be completed, as to them may seem proper, and if
after the granting of permission to use the highways of
said county for the purposes of any such lines of electric
railway as are mentioned in this act, the said commissioners
shall determine, after hearing, that the construction and
completion of any such railway is not being pushed to final
completion with reasonable diligence the said commissioners
shall revoke the same and said commissioners shall grant
no new permission to construct railways under this act,
along the highways of this county until all railways, for
the construction of which along said highways permission
had previously been given, have been substantially com-
pleted, and provided further that nothing herein contained
shall be so construed as to in any manner prevent the said.
