the provisions of this act, Upon conviction thereof except in
|
|
|
|
the cases enumerated the next preceding section, he shall
|
|
|
|
for the first offence pay a fine of not less than fifty dollars
|
|
|
|
nor more than two hundred dollars ; and on conviction of a
|
|
|
|
second offence, he shall pay a fine of uot less than one hun-
|
|
|
|
dred nor more than two hundred dollars, and his license
|
|
|
|
shall be suppressed.
|

|
SEC. 15. And be it enacted, That if any person having a
|
|
|

license under the provisions of this act, shall sell or barter
|
|
|
minors
|
any spirituous or fermented liquors of any kind to any per-
|
|
|
|
son who is a minor or under twenty-one years of age, or shall
|
|
|
|
sell or barter to any person such spirituous or fermented
|
|
|
|
liquors for the purpose of being drunk by any person who is
|
|
|
|
a minor or under twenty-one years of age, or shall give to
|
|
|
|
any person who is a minor, or under twenty-one years of
|
|
|
|
age, any spirituous or fermented liquors, or shall allow, upon
|
|
|
|
the premises occupied by such license, any person who is a
|
|
|
|
minor or under twenty-one years of age, to drink any such
|
|
|
|
spirituous or fermented liquors sold or bartered or given by
|
|
|
|
such license, he shall on conviction, for the first offence
|
|
|
|
pay a fine of not less than fifty dollars nor more than two
|
|
|
|
hundred dollars ; and for the second offense he shall pay a
|
|
|
|
fine of not less than fifty dollars nor more than two hundred
|
|
|
|
dollars, together with the cost of prosecution, or be confined
|
|
|
|
in jail for not less than one month nor more than six months,
|
|
|
|
or both fined and imprisoned in the discretion of the court,
|
|
|
|
and his license shall be suppressed.
|
|
|
|
SEC. 16. And be it enacted, That one-fourth of all money
|
|
|

of this act, shall be held by him for the use of the State,
|
|
|
|
and paid over and accounted for as money received for
|
|
|
|
license, as it has been heretofore accounted for, and the
|
|
|
|
remainder thereof shall he paid by him to the treasurer of
|
|
|
|
the Board of County School Commissioners of Carroll
|
|
|
|
County, for the uses of the public school in said county.
|
|
|
|
SEC. 17. And be it enacted, That druggists and apothe-
|
|
|
|
caries shall not be required to obtain license under the pro-
|
|
|

visions of this act, but they shall not sell intoxicating

liquors, except on the written prescription of a regular
|
|
|
license.

physician, nor more than once or any one prescription of a
|
|
|
|
physician : and every druggist or apothecary shall keep a
|
|
|
|
book for the special purpose, and enter therein the date of
|
|
|
|
every sale of intoxicating liquors made by him, the person
|
|
|
|
to whom sold, the kind, quantity and price thereof, and the
|
|
|
|
purpose for which it was sold : and any failure to comply
|
|
|
|
with the provisions of this section, or produce said book
|
|
|
|
before any court of justice when ordered so to do, shall
|
|
|
|
|
