J. He shall keep open the office of the county commis-

said bond to be approved by the county commissioners and


conditioned for the faithful performance of the duties of the


office of clerk to the County Commissioners of Montgomery


County, as enumerated and set forth in the preceding sub-


sections, and such other duties as may be required of him


by law, or by order of the county commissioners of said


county ; and the said bond, when executed and approved as


aforesaid, shall be recorded in the office of the clerk of the


Circuit Court for Montgomery County, and a copy thereof,


duly certified by said clerk, shall be evidence in any court


of law or equity in this State, and the State of Maryland ;


or the County Commissioners of Montgomery County, or any


person or body politic or corporate, interested or entitled,


may, in the name of the State of Maryland, for his, her or


its use, enter and sustain suit upon such bond for the


recovery of such sum of money as may be due them, or


for the recovery of damages arising from the neglect or


violation of his duties by said clerk to the county com-


missioners.


124. The County Commissioners of Montgomery County


shall annually levy such sum of money as they may deem


sufficient to pay the expenses which may be incurred the

then succeeding year by the attendance of jurors, State's

witnesses, criers and bailiffs of the Circuit Court, and shall


apportion and place the same in the hands of the collector


of taxes of the several collection districts in which it is to


be collected, for collection, and the amounts, when collected,


shall be paid over to the clerk to the county commissioners


to be by him disbursed as is hereinafter provided, and any


of said collectors failing to pay over to said clerk of the


county commissioners one-half of the amount so levied and


placed in his hands for collection, on or before the first day


of November, and the remainder on or before the first day


of March, succeeding the levy as aforesaid, shall, for any


such failure, forfeit and pay to the said clerk to the county


commissioners, to be recovered by him, in his own name,


before a justice of the peace, as other small debts are now
