use a common seal, and purchase and hold real, personal or


mixed property, and sell and dispose of the same for the


benefit of the town.


SEC. 73. The bounds and limits of said town are as fol-


lows : Beginning in the middle of the turnpike east of the

Limits of

town, and at a point south nine degrees forty minutes, east

town,

thirty feet distant from a stone on the north side of the


turnpike marked "82 M. to B.," running first north nine


degrees and forty minutes, west sixty poles to a stone


marked "No. 2;" second, south eighty degrees twenty


minutes west, parallel with the lower end of the main


street of Clearspring two hundred poles to a stone marked


"No. 3; " thence third, south nine degrees forty minutes,


east one hundred and fifty poles to a stone marked " No.


4; " thence fourth, north eighty degrees twenty minutes, east


two hundred poles to a stone marked "No. 5; " thence fifth,


nine degrees forty -minutes, west ninety poles to the place


of beginning.

Election.

SEC. 74. The male citizens of said town of the age of


twenty-one years and upwards, having resided therein for


the space of six months next preceding the first Monday in


May next, on that day, and on the first Monday in May in


each and every year thereafter, be authorized to elect one


burgess, one assistant burgess and three commissioners for


said town, said commissioners to be owners of real estate


therein ; all persons elected shall have resided within the


limits of said town for at least two years next preceding the


election. The services of said commissioners shall be


gratuitous and without pay.


SEC. 75. Jacob Sword, John M. Gray bill and John H.


Anderson of said town, are hereby empowered to act as


judges of the first election for said burgess, assistant bur-


gess and commissioners, who shall keep the polls open from

two o'clock p. m. until six o'clock p. m., and the said judges

shall make returns under their hands and seals of the per-


sons elected, to the clerk of the Circuit Court for Wash-


ington County, who shall issue certificates to the persons


so elected ; and all subsequent elections shall be held and


conducted in such manner and at such place as shall from


time to time be directed by the by-laws of the corporation,


not inconsistent with this charter ; and if any person so


elected as burgess, assistant burgess or commissioner shall


refuse to serve as such, or his place shall become vacant by


death, disqualification or otherwise, an election to fill such


vacancy shall be held, of which ten days' notice shall be


given ; and in case of a tie between any persons voted tor


at any election under this act, the clerk of the court for
