of Maryland, eighteen hundred and seventy -eight, chapter


four hundred and thirty-six, has been reduced to two per-


sons, namely, Edward White and Zadoc P. Henry, thereby


leaving said board without a quorum, and therefore unable


to act, therefore,


SECTION 1. Be it enacted by the General Assembly of


Maryland, That William C. Franklin, James S. Burboye,

and William J. Shockley be and they are hereby appointed

said board of commissioners, who together with said Edward


White and Zadoc P. Henry, shall constitute the five com-


missioners required by law, with power and authority to


appropriate the money in the hands of said commissioners


for the. purpose specified by the law in his case made and


provided.


SEC. 2. And be it enacted, That all moneys and property


of every kind, including all evidence of debt due by or


to the commissioners acting under the provisions of the

viving commissioners of the old board, who shall make a


statement, under oath, of the moneys and property in their


hands as said commissioners, on or before the third day of


May, in the year eighteen hundred and ninety-two, which


statement shall be delivered to the new board created


under this act, and by said new board shall be filed for


record in the office of the clerk for the Circuit Court for


Worcester County, and upon failure so to pay over and


deliver, the commissioners herein named may sue for and


recover the same, and it shall be and is hereby made the


duty of the State's Attorney for Worcester County, when-


ever informed by the board of commissioners created under


this act of the failure of said old commissioners to pay over


and deliver the moneys and property aforesaid, to forthwith


institute suit in the name of the State, for the use of the


said commissioners, created under this act, in the Circuit


Court for Worcester County, and that it shall be the duty


of said Circuit Court to enter up judgment in said suit


against the surviving commissioners, aforesaid, of the old


board, for such sum of money as may be found due without


stay of execution, and in case the said State's Attorney


shall, by execution or otherwise, collect such judgment, he
