faithful performance of his duties of the office of clerk and
|
|
|
|
bailiff respectively, and the said bond shall be recorded in
|
|
|
|
the office of the Circuit Court for Frederick County.
|

|
|
SEC. 106. The council shall receive any election returns
|
|
|

and determine all questions arising thereon, and any person
|
|
|
elections
|
conceiving himself aggrieved by reason of such determina-
|
|
|
|
tion may appeal to the Circuit Court for Frederick County,
|
|
|
|
which shall hear and determine the same, and determine
|
|
|
|
who shall pay the costs of appeal ; in case of a tie in any
|
|
|
|
election for burgess and councilmen, another election shall
|
|
|
|
be held after ten days' notice, pursuant to the provisions
|
|
|
|
aforegoing in regard to elections; in case of vacancy in the
|
|
|
|
office of burgess or councilmen by death, resignation or
|
|
|
|
removal from town, said vacancy shall be filled by a vote of
|
|
|
|
the council, until the next election for members of the
|
|
|
|
council.

|
SEC. 107. The council shall have power to pass all ordi-
|
|
|
|
nances necessary for the good government of the town, may
|
|
|

open, close and widen the streets, lanes and alleys ; prevent
|
|
|
ordinances
|
remove and abate, or cause to be removed or abated all
|
|
|
|
nuisances or obstructions in or upon the sidewalks, streets,
|
|
|
|
highways, lanes or alleys, drains or water courses, or in, or
|
|
|
|
upon any lot adjacent thereto, and to provide for imposing
|
|
|
|
a fine upon any person, causing, creating or maintaining
|
|
|
|
any such nuisance or obstruction ; to remove or cause to be
|
|
|
|
removed houses or other structures or objects that may be
|
|
|
|
dangerous to property, health or persons passing along, or
|
|
|
|
over any of the highways of the town, or residing in the
|
|
|
|
neighborhood thereof; to make reasonable regulations in
|
|
|
|
regard to buildings to be erected in said town ; to make, and
|
|
|
|
establish grades upon the streets and highways of the town ;
|
|
|
|
to cause sidewalks along the public streets and highways of
|
|
|
|
said town to be graded, paved, repaired or made, curbs to
|
|
|
|
be set, and gutters to be laid ; to cause the water-courses,
|
|
|
|
drains or sewers to be paved, kept in repair and cleaned ; to
|
|
|
|
control and protect the public grounds, and property of the
|
|
|
|
town; to establish and regulate a station-house or lockup
|
|
|
|
for the confinement of the violators of the laws and the
|
|
|
|
ordinances of the town ; provided, that the county jail shall
|
|
|
|
be used for such purpose until said council shall deem it
|
|
|
|
advisable to establish and regulate said station-house or
|
|
|
|
lockup ; to levy a tax, and impose a license on dogs or other
|
|
|
|
animals running at large; to prevent horses, cattle and
|
|
|
|
swine running at large in the streets of said town ; and to
|
|
|
|
regulate and control all offensive trades, manufacturers and
|
|
|
|
traffic in offensive fertilizer or other commodities ; and for
|
|
|
|
the purpose of carrying out the foregoing powers, and for
|
|
|
|
|
