dangerous to public safety ; and shall have authority to pass
|
|
|
|
all proper and necessary ordinances and orders to that end ;
|
|
|
|
and shall have full power and authority to impose such
|
|
|
|
fines and penalties as they may deem proper and necessary
|
|
|
|
to carry out and enforce said ordinances and orders, 'and
|
|
|
|
for that purpose shall have the same authority in the col-
|
|
|
|
lection of said fines and penalties as are conferred on said
|
|
|
|
president and commissioners in section one hundred and
|
|
|
|
ninety-six of said sub-title ; provided, that no such fine
|
|
|
|
shall exceed the sum of twenty-five dollars for each viola-
|
|
|
|
tion of said ordinances or orders ; when it may be practica-
|
|
|
|
ble, it shall be the duty of said president and commissioners
|
|
|
|
to do new and general repair work by contracts made after
|
|
|
|
public advertisement for proposals from the lowest respon-
|
|
|
|
sible bidder.
|
|
|
|
200 A. Said president and commissioners shall have
|
|
|
|
power and authority, if in their judgment the protection of
|
|
|
|
life and property demand it, to pass all proper and neces-
|

sary ordinances to require any railroad company, or corpo-
|
crossings-

|
|
ration, running its locomotives, engines or trains across any
|
flagman.
|
|
|
of the streets within the corporate limits of the town to keep a
|
|
|
|
watchman or flagman at the said crossings of the said streets
|
|
|
|
to warn persons of the approach of said locomotives, engines
|
|
|
|
or trains, and the president and commissioners shall have full
|
|
|
|
power and authority to impose such fines and penalties as
|
|
|
|
they may deem proper or necessary to carry out and enforce
|
|
|
|
the powers given by this section ; provided, no such fine or
|
|
|
|
penalty shall exceed the sum of fifty dollars for each viola-
|
|
|
|
tion of said ordinances by such railroad company or corpora-
|
|
|
|
tion ; and such fine or penalty shall be recovered by suit in
|
|
|
|
the name of the corporation before a justice of the peace in
|
|
|
|
and for Cecil Couuty, as other small debts are recovered.
|
|
|
|
201. Said president and commissioners shall have power
|
|
|
|
to provide for the payment of the damages and expenses of
|

opening, widening, laying out, grading, paving, draining,
|

sewering and repairing of streets, lanes, alleys and side-
|

vided for.

|
walks in the town, by levying and assessing the same gen-
|
|
|
|
erally upon the whole of the assessable property of the town,
|
|
|
|
or specifically (not beyond one half of such damage or
|
|
|
|
expense) upon the assessable property of persons benefited
|
|
|
|
thereby ; and in the event that the owner shall be so assessed
|
|
|
|
upon the property of said persons, the amounts so assessed
|
|
|
|
shall be collected by the bailiff of the town under the
|
|
|
|
authority conferred upon him in section two hundred and
|
|
|
|
fourteen of said pub-title, and the said president and com-
|
|
|
|
missioners shall have full power and authority to pass all
|
|
|
|
necessary ordinances to that end.
