SEC. 3. And be it enacted. That the said burgess and


commissioners shall have power and authority,' and are

to be issued, as well as for the payment of the said bonds


at maturity, and shall create a sinking fund for that pur-

the question of issuing the said bonds, shall, at the first


municipal election after the passage of this act, held in the


said town of Middletown, be submitted to the qualified


voters of the said town. If a majority of the votes cast at


the said election favor the execution of this law, the burgess


and conmissioners may proceed to issue the said bonds ;


and if a majority of the votes cast are against the execution


of this law, then it shall be null and void.


SEC. 4. Be it enacted, That the burgess and commis-


sioners of Middletown shall have full power to construct a

Mountain ; near the base of Mount Katalpha, to Middle-


town, by the most feasible route, and likewise all the neces-


sary mains, pipes and fire-plugs, through the streets and


alleys of Middletown ; and that the corporate authorities


be empowered to regulate by a special ordinance the charges


for pipes, hydrants and other supplies for the maintenance


and preservation of said water works intact for the use of


the citizens of the town as well as those adjacent to the


mains leading from the source of supply on the mountain to


the corporate limits of the town.


SEC. 5. And be it enacted, That it shall not be lawful,
