shall provide and have on the day of said election a ballot-box in

|
|
which only the ballots cast under the provisions of this act shall
|
|
|
|
be deposited by said judges of election; and after closing of said
|

polls, the said ballots shall be counted and returned as in cases

duty of said county commissioners and sheriff of said county to

make all the necessary provisions to fully carry out the require-

ments of this act, so that said elections shall be fairly held on

the day aforesaid as elections have heretofore been held in said
|
|
|
|
county.

|
|
|
SEC. 2. And be it enacted, That ballots for or against such
|
|
|
|
prohibition shall have printed on them the words "For prohibit-
|
|
|
|
ing the taking of oysters with scrapes or dredges," or "Against
|
|
|
|
prohibiting the taking of oysters with scrapes or dredges," and
|

the ballots so cast shall be carefully counted by the judges of
|
|
|
|
said election, and that said judges shall make a return of said
|
|
|
|
votes, and deliver said ballots to the clerk of the circuit court for
|
|
|
|
Somerset county, and said clerk shall within five days thereafter
|
|
|
|
make proclamation of the result of said election and cause the
|
|
|
|
same to be published in at least two newspapers printed in said
|
|
|
|
county for at least two successive weeks.
|
|
|
|
SEC. 3. And be it enacted, That if it shall be found by the said
|
|
|
|
returns of the judges of election and proclamation of said clerk
|
|
|
|
that a majority of said votes in said Crisfield, Lawson, Brinkley's,
|
|
|
|
Fairmount, St. Peter's, Dames Quarter, Tangier, Mount Vernon
|

Code of Public Local Laws, title " Somerset County, " sub-title

"Oysters," (to take effect the first day of December, eighteen
|

|
|
hundred and ninety, ) to follow next after section one hundred
|
|
|
|
and ninety-six of said sub-title, and to be designated sub-sections
|
|
|
|
one 1, two 2, three 3, four 4, five 5, six 6, seven 7, eight 8, nine 9,
|
|
|
|
ten 10, eleven 11, twelve 12, and to read as follows :
|
|
|
|
SUB-SECTION 1-1. Be it enacted by the General Assembly of Mary-
|
|
|
|
land, That it shall be unlawful for any person to employ any canoe,
|

boat or vessel in catching or taking oysters with scoop, scrape,

drag, dredge or any similar instrument in any of the waters of

SUB-SEC. 2-2. And de it enacted, That any person or persons

violating the provisions of section one of this act, shall on con-

viction thereof, be sentenced to be confined in the house of cor-
|

years at the discretion of the justice of the peace or the court

|
|
trying the case; and the canoe, boat or vessel so unlawfully
|

|
|
employed shall be forfeited and sold.
