them so to do shall be a misdemeanor punishable as hereinafter


provided.


227 A. They shall also levy annually to said sheriff for carry-


ing and conveying each person under sentence to the penitentiary


or the house of correction, or to or from any of the jails-of any


of the other counties of the State, and the jails or station-houses


of the city of Baltimore, or to or from any other place of confine-


ment outside of Allegany county, under the sentence or final


order of any authorized judicial authority, the sum of twenty-five

pensation whatever shall be granted, allowed or levied for said


sheriff, except such as are specified and allowed by the Code of


Public General Laws relating to sheriffs, and such fee or fees so

allow any other or greater, or additional fee or compensation for


any service than that specified and allowed by the Code of Public


General Laws relating to sheriffs, or shall knowingly violate any


of the provisions of this act, or wilfully neglect or omit to do any


of the things by this act by them required to be done, then and

in such case each of the members of said board of county com-


missioners so voting to levy or allow such other, greater or addi-


tional fee or compensation to said sheriff, shall be guilty of a


misdemeanor, punishable by a fine of not less than one hundred


dollars nor more than five hundred dollars, or by imprisonment


in the county jail for not more than six months or both in the


discretion of the court; and said county commissioners shall keep


in their office a record of the vote of each member on each levy,


and such vote shall' be taken by "ayes" and "nays."


227 D. And it shall be the duty of the State's attorney for

ine and closely scrutinize each annual levy by the county com-
