shall, at the pleasure of said president and directors, be forfeited


to the company and sold for its benefit; but the said president


and directors may remit such forfeiture, or recover in the name


of the company, such instalment by suit or action at law, or in


such other way and upon such terms as they may deem proper.


SEC. 6. And be it enacted, 1 hat the company hereby incorpor-


ated, shall have the power to make and construct a railroad, with


a single or double track and sidings, as they may deem expedient


for the transportation of passengers and freight by horse, traction


or electrical power, from Curtis' creek, in Anne Arundel county,


beginning for the same at or near the water on Curtis' creek or


Cabin branch, and running along such streets and avenues and


county roads as the company deem fit, to the southern terminus


of Light street bridge; thence northerly al6ng and upon said


bridge to the north terminus thereof; thence still northerly to


connect with southern terminus of the Baltimore city passenger


railway on Marshall street, in Baltimore city, or to such other


place or places as may be deemed most advantageous to the inter-


est of the company; provided, however, that nothing in this sec-


tion or act contained, shall authorize said company to use steam


motive power on their said railroad, or any part thereof, or any

larger motor, cars or carriages thereon, than such as are usual,

and at the time being permitted in the city of Baltimore, on


street railroads in said city; and provided, further, that said


company in constructing its said railroad over and upon said


Light street bridge, shall use an iron or steel rail, having a flange


such as will correspond with that used by the city passenger rail-


way in Baltimore city, and shall not lay more than one track on


said bridge and that as close as may be to one side of said bridge;


and shall at its own cost and expense construct and keep in re-


pair an extra floor, to cover and rest upon the ordinary or usual


flooring of said bridge, which said extra floor shall cover the


entire space between the rails, and a space of at least six inches


on the outside of the inner rail, and shall be raised to the level


of the top of said rails and shall be levelled on its edges so as to

admit of being readily crossed by vehicles; and provided, further

that in constructing its said railroad, the said company shall lay

its said track or tracks on the margin or margins of said streets

avenues and county roads, and in such manner as not to interfere

with the free and convenient use of such streets, avenues and

county roads, and shall leave unoccupied and unobstructed by said

track or tracks and by the cars, motors or carriages using or run

ning upon the same, a width of at least fourteen feet for vehicle

using said streets, avenues and county roads.

SEC. 7. And be it enacted, That the said company be and they

are hereby authorized in the constructing of said railroad over

the streets, avenues, and county roads aforesaid, to alter the grade
