that the justice of the peace residing in said town shall have the


same power to hear, try and determine all criminal cases where


the mayor and council is a party, as they now have in cases where


the State of Maryland is a party.


SEC. 22. And be it enacted, That the bailiff shall have the same


fees for making distress or levying execution for taxes as are al-


lowed county collectors, and for making arrests or serving process


for violation of any ordinance of the corporation the same fees :

wilfully fails to discharge any duty of his office he may, in addi-


tion to the remedy on his bond, be fined by the mayor in his dis-


cretion, not exceeding ten dollars for any one offense, for the pay-

dismissed by the council.


SEC. 23. And be it enacted, That all fines, penalties and for-


feitures imposed by this charter, or by any ordinance of the coun-


cil, may be collected in the name of the mayor and council be-
