That article four, of the Code of Public Local Laws, title "City
|
|

|
of Baltimore," sub-title "Courts," be and the same is hereby
|
|
|
|
amended by adding an. additional section thereto to follow section
|

one hundred and sixty-nine of said article, and to be known as
|
|
|
|
"Section one hundred and sixty-nine A," and to read as follows :
|
|
|
|
SEC. 169 A. If the defendant shall dispute the whole or any
|
|
|
|
part of the plaintiff's demand in any action brought under the
|
|
|
|
provisions of the three foregoing sections and upon trial of the
|

case the plaintiff shall recover a judgment for any portion of his
|
costs.
|
|
|
demand so disputed, then the plaintiff shall be allowed in addition
|
|
|
|
to the costs of the suit reasonable counsel fees to be fixed by the

|
|
|

than one hundred dollars.

|
|
AN ACT to incorporate the Marist society.
|
|
|
|
WHEREAS, the Reverend James Gibbons, Reverend Alphonsus
|
|
|
|
Magnien, Reverend Edward R. Dyer, Reverend Thomas Henry
|
|
|
|
and Reverend Jacob James Joyce, by their petition to this Gen-
|
|
|
|
eral Assembly of Maryland, have set forth that they are all citi-
|
|
|
|
zens of the United States, and a majority of them citizens of this
|
|
|
|
State, that they have formed themselves into a society by the
|

|
|
name of the Marist society for religious, educational, literary and
|
|
|
|
charitable purposes, and are about to purchase in fee-simple land
|
|
|
|
in this State upon which they propose to erect suitable buildings
|
|
|
|
for a residence for the members of said association and for a school
|
|
|
|
and to apply their means so far as may be possible to gratuities,
|
|
|
|
and they have prayed an act of incorporation for the more con-
|
|
|
|
venient holding and transmission of their property, which being
|
|
|
|
reasonable and in accordance with previous policy of this State ;
|
|
|
|
therefore,
|
|
|
|
SECTION 1. Be it enacted by the General Assembly of Maryland,
|
|
|
|
That the said James Gibbons, Alphonsus Magnien, Edward R.
|
|
|
|
Dyer, Thomas Henry and Jacob James Joyce and their successors
|
|
|
|
be and they are hereby created and made a body politic and cor-
|
|
|
|
porate by the name of the Marist society, and by that name shall
|
|
|
|
have succession with full power and authority to provide for the
|

admission and rejection of members, and to make all by-laws
|
|
|
|
necessary for the government of the society, to have and to use
|
|
|
|
a common seal, to purchase and take by deed or otherwise any
|
|
|
|
real, personal or mixed estate, for the purpose aforesaid, and the
|
|
|
|
same or any part thereof, to sell and dispose of at their pleasure,
|
|
|
|
and to sue and be sued, plead and be impleaded; but this charier
